Small claims courts have limited jurisdiction that hear civil cases
between private citizens. Small Claims Court may have other legal
functions, the name of the court varies by its jurisdiction. It may be

Small Claims Court
Purpose and Operation
Small Claims Court usually presides over small private disputes up
to $5,000.00 in most states. Collection of small debts owed as well
as evictions and other disputes between landlord and tenant are
heard hear unless the jurisdiction is covered by a tenancy board.
A Small Claims Court will have a maximum cash limit to the amount
a person can receive. The Plaintiff waives any right to claim more
than the court can award. The plaintiff may or may not be allowed
to reduce a claim to fit the requirements of the court. In Texas this
is not allowed, they call it court shopping. You can not reduce the
amount of damages claimed in order to fit a trial into a court that
would otherwise not have jurisdiction. (Example, you can not claim
damages of $10,000.00 hoping to to get $5,000.00 in Small Claims

The court will dismiss the case because the court does not have
jurisdiction to hear cases greater than the amount that they can
award. Even if the Plantiff is willing to take less than the full
amount, the court will not hear the case.
The Plaintiff must claim and prove the actual damages were within
the court's jurisdiction. Depending on the case, if the Plaintiff loses
their case in Small Claims Court, they are entitled to a trial in a court
of more jurisdiction and with a more formal procedure.
Rules and Procedures
The rules of civil procedure and some evidence are altered and
simplified in order to make the case economical. One rule in these
courts is that an individual should be able to conduct their own case
and represent themselves without recourse to a lawyer.

Even though some rules may be relaxed, they still apply to some
degree. In some jurisdictions, corporations must still appear
represented by a lawyer in Small Claims Court. Depositions and
interogatories are usually not allowed in Small Claims Court. All
matters are set for trial. If the defendant does not show up at trial
and has not requested a postponement, a judgement may be entered
against them by default. A trial by jury is seldom held in Small
Claims Court. Equitable remedies such as injunctions, including
orders of protection, are seldom available in Small Claims Court.
Family Court matters are heard in Family Court. For reasons having
more to do with history than with the sort of case typically heard
by a small claims court, most US states do not allow domestic
relations disputes to be heard in small claims court. You can find

Judgements
Winning in Small Claims Court does not ensure payment of a
plaintiff's damages. If the defendant is insured it may be easier to
recoupe your loss compared to trying to get your money from a
party who is not working and has no visible means of support.
You can collect the judgement by wage garnishment or a lien, if
they own any real property. Most courts encourage parties to settle
their disputes through arbitration as an alternative to resolving the
dispute, if possible, before filing for suit. Click Here.
Claim
A claim is a legal action to obtain money, property, or the
enforcement of a right against another party. The legal document
which carries a claim is called a Statement of Claim. It can be any
communication notifying the addressee of alleged faulty execution
which resulted in damages, often expressed in amount of money the
party should pay/reimburse.
There are several issues of concern when filing a statement of
claim. Although to file a Statement of Claim is fairly straight
forward, it is important it be done properly or you may lose your
case due to a simple technicality.
