Heating Complaints

Heating complaints in the winter time is one of the major reason why
Tenants sue their Landlords.

As I sit here at my desk, it is 26 degrees outside. NYC braces itself for its
first snow storm of 2009.

The weather man expects anywhere from 6-12 inches of snow. Heavier out
on Long Island.

This will make a very nice winter holiday for the kids.

It will also make it a very dangerous part of the year for families without heat.

311 complaints for no heat will start to rise.

Buildings with old boilers will malfunction. Improperly sealed windows and
doors will cause drafts.

When the weather outside gets brutal, so does human beings.

This is the season for lawsuits, for slip and falls.

Sorry! I couldn't resist that little quip there.

Let's get back to the matter at hand.

Tenants need to know their rights in these situations and Landlords need to
know their obligations in regards to heating complaints.


Landlords Obligation as to Providing Heat:

  • If you are a Tenant, your Landlord is responsible to provide heat for
    your apartment between the hours of:

  • 6am -10pm if the outside temperature is below 55 degrees, the inside
    temperature must be 68 degrees or more.

  • 10pm -6am if the outside temperature is below 40 degrees, the inside
    temperature must be more than 55 degrees.

If You Have Problems With Heat In Your Building:
Use the form below to record the inside and outside temperature. Call the
Weather Bureau at (212) 976-1212 to get the official outside temperature.
Use a thermometer to take the temperature inside your apartment.

Call the Central Complaint Bureau at (212) 824-4328 to register your
complaint. You should call each day you have a heating problem. They are
open 24 hours a day, 7 days a week.

Write and call your landlord. Send letters by certified mail, return receipt
requested and keep a copy of the letter. Keep a list of each date and time
you called your landlord to report a heating complaint.

Consider organizing a tenant's association and filing an HP Action against
your landlord in Housing Court. If you live in a rent regulated apartment,
consider filing a heating complaint with the Division of Housing and
Community Renewal (718) 519-5678.
